$1.9 Million Wrongful Death Settlement

Peck Baxter attorneys, Shaun L Peck and Loren K. Peck recently secured a $1.9 million settlement for a client following a devastating motor vehicle collision that resulted in the death of a family member.

The lawsuit arose from a collision at a Utah intersection. According to the complaint, a company-owned pickup truck entered the intersection against a red traffic signal and struck the driver’s side of the decedent’s vehicle as she traveled through the intersection on a green light. She suffered life-threatening injuries and later died from those injuries.

The case involved more than the conduct of a single driver. Peck Baxter pursued claims against multiple parties and investigated whether roadway construction and traffic-control conditions contributed to the collision. The complaint alleged that construction had altered the normal traffic pattern near the intersection, including converting a right-turn lane into a through lane, potentially affecting visibility of both approaching traffic and the controlling traffic signal.

Peck Baxter asserted claims involving negligence, negligence per se, vicarious liability, and alleged failures relating to the design, implementation, and monitoring of the traffic-control plan. The lawsuit sought recovery for the economic and non-economic losses resulting from the death, including the loss of companionship, society, and support suffered by the decedent’s family.

Following litigation of the case, Peck Baxter negotiated a resolution providing $1.9 million in compensation to the client.

While no financial recovery can undo the loss of a loved one, the settlement provided meaningful compensation and brought the litigation to a conclusion for the family.
