Nathan A. Duncan, Partner


 

Born in Provo, Utah and raised in Central and Northern California, Nathan A. Duncan received his Bachelor of Arts degree in philosophy from Brigham Young University in 2004. He subsequently attended law school at the University of Missouri-Columbia where he earned his law degree in 2007. Nathan practiced in Missouri for twelve years before joining Peck Baxter Watkins & Bailey in 2019. Nathan practices in the areas of serious personal injury, wrongful death, class actions, civil rights, and products liability. During the course of his career, Nathan has recovered millions of dollars for his clients.

Nathan is admitted to practice in Utah and Missouri and before the United States District Courts for Utah and for the Western and Eastern Districts of Missouri. Nathan has been selected as a SuperLawyers-Rising Star in the State of Missouri every year since 2012. In 2015, the National Trial Lawyers Association named Nathan as one of its “Top 40 Under 40” personal injury lawyers. In 2018, the National Trial Lawyers Association named Nathan one of its “Top 100” civil plaintiff’s lawyers. He was part of a team of attorneys who secured the largest settlement in the Missouri in 2018 and the largest civil judgment in Missouri in 2018. Nathan is the proud dad to five children: Mackenzie, Tyler, Avery, Cole, and Tanner.


Significant Case Results

 $763,687.50  Dental Malpractice Verdict

On January 17, 2025, a Davis County jury returned a verdict of $763,687.50 in favor of Nathan’s client who brought medical malpractice claims against a corporation that operates orthodontic clinics across Utah and a general dentist who ran one of the clinics. The negligent treatment defendants provided our client resulted in extreme gum recession, bone loss in her jaw, and debilitating sensitivity throughout our client’s mouth. Our client was represented by Nathan at trial.

The verdict appears to be the highest dental malpractice verdict in Utah history. 

$7 MILLION DAMAGES AWARD IN CASE OF SEXUAL ABUSE

After a one-day evidentiary hearing on damages, a Salt Lake County judge awarded a Peck Baxter client a judgment of $7 million for the sexual abuse she endured as a child. The client is represented by Shaun L Peck and Nathan A. Duncan.
